Terms of Service

These terms form an agreement between you and TrackThem ("we", "us", "our"). By creating an account or using TrackThem, you agree to them. If you're using TrackThem on behalf of a business, you're confirming you have the authority to bind that business to these terms.

TrackThem is currently operated by an individual based in France, ahead of formal incorporation. This section will be updated with the registered legal entity's name and details once one exists.

1. What TrackThem does

TrackThem monitors public e-commerce store pages you choose to track and tells you when something meaningful changes — a price move, a new or removed product, a stock change, a new promotion, or a homepage/collection change. For each tracked competitor you describe, in plain language, what you want to be told about. TrackThem checks those pages on a schedule, scores each change by its likely impact, and — on paid plans — turns high-impact changes into a short recommended action plan. Alerts are delivered by email as a real-time or digest summary.

You can optionally connect your own store so that recommendations are weighed against your actual catalog (your products, prices, and collections) instead of generic advice.

2. Accounts

You need an account to use TrackThem. You're responsible for keeping your login credentials secure and for all activity under your account. Tell us right away if you suspect unauthorized access.

3. Plans, billing, and cancellation

TrackThem offers a free tier and paid plans (Starter, Growth, Scale). Paid plans are billed as a recurring subscription through Stripe, in advance for each billing period. Each plan sets how many competitors you can track, how many checks you get per month, how frequently pages are checked, and how long your change history is kept. You can cancel or change plan at any time from your dashboard or the Stripe billing portal; cancellation stops future renewals but you keep paid access until the end of the period you already paid for, after which the account returns to the free tier. Free-tier and monthly quotas reset on the first of each calendar month. Except where required by law, fees already paid are non-refundable.

4. Acceptable use

You agree to:

• Only track publicly accessible store pages. Don't use TrackThem to reach content behind a login, paywall, or any access control you're not authorized to bypass.
• Not resell, redistribute, or systematically re-publish the tracking data or action plans we generate as your own product or data feed.
• Not attempt to bypass usage limits, rate limits, or plan restrictions, or interfere with the service's infrastructure.
• Not use TrackThem to harass a specific individual or to build a competing product using our outputs.

We may suspend access if we reasonably believe your use violates this section.

5. Monitoring third-party sites

TrackThem reads publicly available pages the same way any browser or search engine does. You are responsible for ensuring your monitoring of a given site is lawful in your jurisdiction and consistent with that site's terms. TrackThem only accesses pages that are public; it does not log into, or attempt to access, private areas of a competitor's site.

6. Your content

You retain ownership of the URLs, competitor lists, observations, and any store details you submit. By submitting them, you grant us a limited license to process that content solely to run the monitoring and features you've activated — we don't use it for any other purpose, and we don't claim ownership over your business data.

7. Our content

The TrackThem software, branding, scoring methodology, and report/action-plan format are our intellectual property. The alerts and action plans we generate for you are yours to act on and share internally — but you may not resell them or republish our formats as your own product.

8. AI-generated content

Change summaries, impact scores, and recommended action plans are generated by an AI model and are provided for informational purposes only. We don't guarantee any specific business outcome from following a suggestion — you're responsible for evaluating any action before you take it. AI outputs can occasionally be inaccurate or miss a change; use your own judgment and verify anything important against the source page, which we always link.

9. Availability and delivery

We aim for reliable uptime but don't guarantee the service will be uninterrupted or error-free. Checks run on an external schedule and depend on third-party services (page capture, AI scoring, email delivery), so a specific check or alert may occasionally be delayed or fail. Some stores actively block automated traffic; where a page can't be read, TrackThem falls back to its public product feed where available and tells you when a page can't be checked. We're not liable for a missed or delayed alert caused by a third-party outage outside our control.

10. Disclaimer of warranties

TrackThem is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the extent permitted by law, TrackThem and its team are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost sales, or business decisions made based on an alert or action plan, even if advised of the possibility. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the service, your violation of these terms, or your monitoring of a site in a way that infringes a third party's rights.

13. Termination

You can delete your account at any time from your settings; doing so permanently removes your account data and cancels any active subscription. We may suspend or terminate accounts that violate these terms, abuse the service, or fail to pay applicable fees, with notice where reasonably practical.

14. Changes to these terms

We may update these terms as the product evolves. Material changes will be reflected by updating the date at the top of this page; continued use after a change means you accept the updated terms.

15. Governing law

TrackThem is operated from France. These terms are governed by French law, and any dispute not resolved informally is subject to the exclusive jurisdiction of the French courts, without regard to conflict-of-law principles. This section will be updated to name a registered legal entity once TrackThem incorporates one.

16. General

If any provision of these terms is found unenforceable, the rest remain in effect. These terms are the entire agreement between you and us regarding the service, superseding any prior agreements on the same subject. We may assign these terms in connection with a merger, acquisition, or sale of assets; you may not assign your rights without our consent.
